Legally you are right of course, ie we could have signed our advantageous contract with or without brexit. However, few believe we would have been able to hold our current position (from a political perspective) had we still been in the EU

Of course you could. If you chose to go it alone, why not. Unless the UK lawyers also looked at the EU contract and alerted them to the escape route AZ had with them.
